"Dardanella," which was one of the most suc-
cessful instrumental compositions in the last dec-
ade, has been the cause of a series of legal con-
troversies. The most recent action is that of
Fred Fisher, Inc., against Charles Dillingham,
T. B. Harms Co., Inc., Jerome Kern, Anne
Caldwell and Edward Royce, which charges the
defendants with infringing on the above number
by the publication of the hit song from "Good
Morning, Dearie," "Ka-Lu-A." The answer of
the defendants was a general denial, including
that "Dardanella" is not an original composition,
and in a separate defense states that notes and
arrangements of "Dardanella" have long been
held in public use and domain and are not copy-
righted.
