CONDEMNS TAX ON RADIO
Secretary of the Radio Protective Association Tells
How It Would Result in Injustices.
Any effort to tax radio listeners—even if only for
the support of the radio commission—will result in
injustices and inequalities, that are almost certain to
be followed by efforts to impose taxes on listeners to
support broadcasting stations and eventually pay
heavier patent royalties than are already being paid
by the public, according to L. A. Nixon, eastern sec-
retary of the Radio Protective Association.
In discussing the proposal of Representative Will
R. Wood, chairman of the house sub committee on
appropriations, who suggested that radio receiving
sets be taxed to provide revenue for the Federal
Radio Commission, Mr. Nixon pointed out the ex-
treme difficulties of collecting a head tax from listen-
ers as is attempted in Canada and England. "Because
of the very smallness of the tax that might be
assessed the individual it will be difficult of collec-
tion," he said.

Use of popular songs in commercial radio pro-
grams is asserted to be an infringement of copyright,
in a suit filed in the Federal District Court, Minne-
apolis, last week.
The action was started by Gene Buck of New
York, president of the American Society of Com-
posers, Authors and Publishers, and is against Dr.
George W. Young, an optometrist and jeweler, who
operates station WDGY of Minneapolis.
The complaint contends that Dr. Young's station
used "My Blue Heaven" in a program on Dec. 20.
Preceding and following the song the announcer is
alleged to have said: This is station WDGY, oper-
ated by Dr. Young's jewelry store. Dr. Young will
save you 20 per cent at his store."
