all important phases of an operation of any
type of equipment, within a given location.
Last month THE REVIEW checked back
on a group of operators in various parts of
the country to see just how successful thi s
agreement has proven and if it has with•
stood the test of time and is still fun ction.

2. Opera tor agrees to se rvi ce and ma intain such equipment at hi s own expense and
to repl ace such equipment from time to time with other equipment of th e sam e type, wh en
such replacement becomes necessa ry ; the Operator to be sole judge as to tim e of r epl ace.

3. Opera tor furth er agrees to connect such equipment to th e electric current in case
such operation is necessary.
4. Merchant agrees to accept and by this presents does hereby accept the installation
of such equipment above mentioned in his business and agrees to place it within hi s
esta blishm ent in such a place so as to be of best advanta ge to both parties.
5. Merchant furth er agrees that he will not himself, or permit any other person to
damage, injure, interfere with or tamper with said equi pment, and that he will, imme•
diately, notify the Opera tor as soon as any of said equipment beco mes out of ord er ; that
he will pay fo r electrical current consume,d by such equipment and not call upon the
Opera tor to bea r any expense for the use the reof.
6. Mercha nt ag rees th at he will not install, permit to be installed or used, equipment
of a ny other person, firm or corporation of a like or similar description or design, durin g
the term of this contract and that the Operator nam ed herein shall have th e exclusive
ri ght to operate such equipm ent in Merchant's place of busin ess for the term of this
contract.
7. Any loss to equipment by reason of fire, earthquake, theft, or burglary shall be
born e by th e Operator, unl ess loss or damage is caused or contributed by any action on
th e pa rt of the Merchant.
8. All receipts derived from sa id equipment shall be divided as follow s:

the United Sta tes Government on the afo remention ed equipment.

using difficult forms and who wish to adopt
a proven agreement form. It will be noted
that provision has been made for the han-
dling of United States taxes on equipment
operations. In some instances operators
have revised this to include local, county
or state taxes. Such an inclusion seems
only justifiable und er present conditions
and, in some cases, thi s paragraph has been
re.written so that the entire taxes on a
particular piece of equipment have been
paid by the location, or deducted from the
location share of th e receipts. Operators
will re.write this paragraph to conform to
their established policy in the matter of
taxes.
