Antitrust falls out·of·court
Bally Manufacturing Corp . and
Williams Electronics Inc . have settled
all of their disputes out-of-court
relating to the manufacture and sale
of slot machines. An announcement
by the respective legal counsellors
said the settlement includes a $1.4
million payment by Bally to Williams.
a subsidiary of XCOR International
Inc.
Antitrust litigation pending be-
tween Bally and Williams in federal
court in Chicago and in state court in
ew Jersey has been dismissed. said
the May 27 announcement. Patent
litigation which has been brought by
Bally against Williams. pending in
Chicago. was not affected by this
settlement.
Legal spokesmen for both Williams
and Bally agreed that their settlement
over slot machines used in Atlantic
City and elsewhere "does not reflect
on the merits of Williams' claims
against Bally or Bally's claims against
Williams ." Rather. both firms stated
they wished "to bring this lengthy
and expensive litigation to a conclu -
Sion .
Glenn
eidenfeld. secretary and
general counsel of Bally. told PLAY
METER. "All matters pursuant to
antitrust are dropped .··
The attorney explained that
Williams had alleged that Bally's sale
of slots in Nevada and ownership of
the Park Place casino-hotel in
Atlantic City violated antitrust laws.
Bally had counter-claimed that
Williams conspired with other slot
machine manufacturers to mislead
the New Jersey Casino Control
Commission so it would adopt
regulations limiting a casino's pur-
chase of slots to 50 percent from one
manufacturer .
Bally. however. received a waiver
from the commission on that rule for
Park Place. reports said.
The legal action. filed in Chicago
and New Jersey. included claims of
$30 million by Williams and $60
million by Bally .
A federal grand jury inquiry into
possible antitrust violations in the
gaming equipment industry began in
May of 197 . Both Williams and
Bally indicated their support of the
federal probe.
