A suit was filed in the Supreme Court this week
against Daniel V. Arthur and Lee Shubert as co-
partners to recover $1,989 due as royalties for the

production of the opera "Judy Forgot." The suit
is brought in behalf of Silvio Hein, the composer
of the music, and it is alleged that between Sep-
tember 28, 1910, and May 20, 1911, the royalties due
amounted to $3,983, of which $1,989 is unpaid.

Those in close touch with musical circles are
much excited over the news that Gabriel d'Annun-
zio and Pietro Mascagni are collaborating in z
tragic opera.
Music lovers are all agog to see how the com-
bination will turn out. Mascagni has the reputation
of being difficult to deal with. His temper is un-
certain and he is very determined in his ideas,
while tlie poet is uncertain in his character and
engagements and equally decided in his opinions.
How they will go in double harness is an inter-
esting question. Their enemies say that we shall
see them in the law courts before many weeks have
passed. However that may be, the partnership is
now sailing on smooth waters.
The subject of the opera, as usual where d'An-
nunzio is concerned, is unpleasant. It was left
to his free choice. It distinctly resembles the story
of Paolo and Francesca.
