Before all automatic music operators will be forced
to pay royalty to ASCAP, BMI, and other such copyrighted
music organizations, there's still a question that begs
an answer.
So £ar it's been MOA (Music Operators of America) who
agreed to pay $8 per year royalty per juke box to the
copyrighted music organizations. Which means, it must be
conjectured, that MOA is speaking for all its members.
But there are music operators in the U.S. who are not
members of MOA. Do these music operators also agree to
such royalty payment?
Would it be in keeping with constitutional procedure,
before an amendment could be passed, to grant these automatic
music operators, who are not members of MOA, a hearing, before
attempting what might prove taxation without representation?
