expressions are akin to our First Amendment freedoms. Certainly
as akin, if not more akin, than constitutionally unprotected obscene
matter that was considered in Stanley supra.
It follows then that this court appreciates the distinction as
it must when the fundamental rights of an individual are at
stake, that this "slot machine" may not be likened to narcotics,
firearms, or stolen property as the State argues.
Ownership of narcotics and firearms should not be confused
with the privacy rights of one owning a "slot machine" in his
home. Clearly, the former manifests a potential or imminent
danger to the person whereas the latter does not, while the
former's inherent expressive capability is miniscule, while the
letter's is not insignificant.
It is further submitted the holding of unconstitutionality of
the proscription of the subject "slot machine" in one's home
will not enhance the rights of an individual to possess or "own"
stolen goods in one's home; for, clearly, the Holy Bible, a pre
sumable protected First Amendment item, is non-protected if
it is stolen.
Therefore, this court must conclude that although the State
retains the broad power to curtail gambling and the use of slot
machines, the U.S. and Illinois Constitutions prohibit the pro-
cription of the private ownership of a "slot machine" as character
ized herein. See:

Therefore, it is hereby ordered that the defendant's Motion
to Dismiss the Information is granted. People v Lawson 67 III.
2nd 449, 367 NE 2nd 1244 (1977) The coin operated slot machine
is ordered returned to the Defendant.
