New Measure Entered to Force June 17 Cov-
ers Every Species of Intellectual Property,
Including Rolls and Records.
A new copyright law, No. 345, of March 17, 1925,
entered into force in Chile on June 17. This legisla-
tion has been urged for several years, on account of
the practical difficulties in the application of the law
of 1834 for the protection of such property as motion-
picture films and musical records.
Copyrightable subject matter has been extensively de-
fined and includes any form of intellectual expression,
whether scientific, artistic, musical, literary, or dra-
matic. The exclusive right is granted to owners of
intellectual property to reproduce it in any manner
whatever, including such means as motion-picture
films, phonograph records, music rolls for mechani-
cal instruments, and radio-telephonic transmission.
The progress of the law is best indicated in the
enumeration of the new forms of reproduction of in-
tellectual property which could be read into the old
law only on the broadest principles of construction.
A further condition which must be fulfilled before
protection will be granted is that the copyrighted
work must bear announcement of the registration
number in a conspicuous place on each copy. Omis-
sion of this notice deprives the owner of the intellec-
tual property of any claim to the exclusive enjoyment
of the rights conferred by the law. Publication of
such notice on works which are not copyrighted in
Chile, for the purpose of inducing error with respect
to the property, is punishable by a fine.
Copyright endures for the life of the author and
passes to his heirs upon his death for a term of
twenty years thereafter.
The unauthorized reproduction of a copyrighted
work in any of the forms referred to in the law, and
the utilization for profit of copies so reproduced, con-
stitute an infringement and are subject to the imposi-
tion of the corresponding penalties and the payment
of, damages to the injured party.
An injunction restraining the sale, circulation, ex-
hibition, or execution of the work may be granted
upon petition of the complaining party during the
course of the trial. The court also, upon motion of
the injured party, may order the publication of the
sentence at the cost of the infringer.
REMARKABLE INVENTIONS.
The Victor Talking Machine Company last week
announced that it was soon to place on the market an
improved instrument that would prove "a knock-
out." The statement followed by just twenty-four
hours the announcement by the Brunswick-Balke-
Collender Company of the Panatrome, a substitute
for the phonograph which has been developed by the
Radio Corporation of America, the General Electric
Company, the Westinghouse Electric Company and
the Brunswick Company. Quite a full story of the
