instituted suit in the Federal Court asking for a
restraining order against Gene Buck, president
of the American Society of Composers, Authors
and Publishers, from printing, selling, broad-
casting or otherwise using the song "Maybe,"
and all other songs and musical compositions
belonging to the plaintiff. An order is also
sought to compel the defendants to account for
all of the licenses issued permitting the broad-
casting of songs and musical compositions be-
longing to the plaintiff, and damages sustained
by reason of the alleged illegal acts of the
defendant are asked for.
The firm of Waterson, Berlin & Snyder signed
an agreement on February 1, 1921, with the
American Society which expires January 1,
1926.
It is contended, however, by the plaintiff,

New Musical Comedy, With Lyrics by Wode-
house and Music by Kern, Has Premiere on
Broadway—No Mechanical Reproduction of
Music
A new musical comedy called "Sitting Pretty,"
book by Guy Bolton, lyrics by P. G. Wode-
house, and music by Jerome Kern, was recently
given its premiere by the producers, Comstock
and Gest, at the Fulton Theatre, New York City.
This marks a return of the authors as a writing
trio, the same names being responsible for some
musical comedy successes for some years back.
Mr. Kern, of course, is well known and has con-
tinued to write the music for shows each year,
Wodehouse only contributing lyrics occasion-
ally, and Bolton confining his attention to more
legitimate forms of drama.
The reunion of these writers reopens auspi-
ciously. The show, undoubtedly, is an assured
success. The metropolitan dailies were unusually
liberal in treating it and there are other indica-
tions that mark it an outstanding offering.
Queenie Smith is starred in the production
and some of the other important figures are
that at the time the agreement was made no
commercial or public use was being made of
songs or musical compositions in connection
with radio broadcasting and that, therefore,
such use was not within the contemplation of
the plaintiff or the Society.
The suit which, undoubtedly, will be in the
nature of a test case, also includes besides the
American Society, the firm of D. W. May, Inc.,
of Newark, N. J., which has been licensed by
the Society to broadcast various songs and
compositions.
Unusual interest has been aroused by the
above, legal action in both publishing and broad-
casting circles. The progress of the suit will
be eagerly watched and the final decision will
have an important bearing on the future rights
of copyright owners, especially in regard to the
radio situation.

catalog of school music particularly available as
a reference work. It carries the title, "The
Supervisors' Handbook of School Music." It
is a carefully classified handbook with many
voice arrangements covering a wide scope of
musical needs, from kindergarten studies to high
school years. Among its features is a list of
school courses, divided into nineteen classifica-
tions, covering all seasons of the year and pa-
triotic and religious holidays. Under proper
Gertrude Bryan, Dwight Frye, Myra Hampton headings the familiar songs, folk songs, slumber
and Frank Mclntyre. The production is well songs, operatic selections and sacred songs
