FUTILE LITIGATION IN TRADE
Suits Penoing in Fall Terms Altogether Too
Many-Trade. Has Arbitration Board at Its
Disposal but Fails to Use It

wi ll be thrown ou t of the COllrts altogether when
th e September terms open. In other cases th ey
wi ll be pro lon ge d for weeks o r months by th e
energet ic efforts of the contes ta nts and their
attorneys for a decision.
The point, h owev er, that is well wo rth con ­
si derin g by everyo ne in the m usic publishing
busines<; is that m ost of the cases w ill be futile.

nor the ha rd feelings that wi ll follow such con­
tests. The history of all suc h cases during th e
past de ca.de shows that the ma jority of such
su its on ly involve attorney and court expe nse s
fo r all partie s.
The Music Publishers' Protective Association
has done much to eradicate the evils of plagia­
rism. It has also discouraged such su its where­
ever poss ible, bu t a fair amo unt of legal action
of th is caliber continues to land in the courts.
Pro-ba b ly it win co ntinue to do so, until the ex­
penses incurred dem onstrate to such contestants
the advisability of taking ad vantage of the board
of a. bitratio n of the Music Publishers ' Protec­
tive Assoc iation , thu s el imi nating the expenses
a nd the ha rd feelings that necessarily follow
what are in man y cases unadvisable and useless
actions.
FALL CAMPAIGN OF JACK MILLS, INC.
Jack Mi lls, Inc., which recently m oved into
its ne w building, 150 \V est Forty-sixth street,
New York City, plans a Fall cam pa ign on the
fol lo wing s on gs: "Ju st a Girl That Men For­
ge t," a ballad which is receiving except ional
popul arity in vaudevi lle; "Hey! Yo u Want An y
Cod Fish ?", a novelty, and "Love Is Ju s t a
Flowe r" and "Havana," bo th of th e lat te r from
the Pacific Coast. The catalog serie s of "Be au­
tiful Ba llads" wi ll al so be exploited.'
