Hit of the New Winter Garden Show
Following the decision of the United States
Supreme Court last week, under which cabaret
and cafe orchestras are restrained from using
copyrighted music without permission, Chas.
Dillingham, manager of "The Big Show" at the
Hippodrome, notified the cabarets to discontinue
the use of "Poor Butterfly," the great hit of
that production. Nathan Burkan, the attorney,
following the instructions of Raymond Hubbell
and John Golden, composers of the piece, and
T. B. Harms and Francis, Day & Hunter, pub-
lishers of the music, notified the Geo. Rector
Co. to discontinue the use forthwith of the "Poor
Butterfly" number in the cabaret performance
at their restaurant.
JASS BAND MUSIC^'OLD STUFF"?
CHICAGO, I I I . , January 27.—There is hope for
Brahms, Liszt and possibly the great Wagner.
Modern composers are shorn of their glory in
a statement made by Professor Robert Stevens,
musical director of the University of Chicago,
on the ancient origin of jass music. The above-
named old masters wrote really good jass band
music, states the professor, much better than
any of the present compositions.
ISSUING ARTISTIC SHOWCARDS
Leo Feist, Inc., are getting out some very
artistic showcards for the better class sheet
music stores on their ballad success, "Love,
Here Is My Heart." This song has been fea-
tured by John McCormack for sometime in his
concerts, and is one of the best selling num :
bers in the Victor record catalog for the past
two months. The record is also by McCormack.
LAW PROTECTS RATIONAL ANTHEM
CHICAGO, I I I . , January 29.—A new ordinance ap-
proved by the City Council last week, forbids,
under a heavy penalty, the playing of the "Star
Spangled Banner" as part of a medley. The
ordinance will have the effect of preventing
cabaret orchestras from playing the national an-
them as dance music.
WENRICH SINGINGJWN NEW SONGS
Percy Wenrich and Dolly Connolly opened
at the Riverside Theatre, New York, on Monday
of this week. Among other songs Mr. Wenrich
is featuring two of his own compositions with
success, "Silver Bay" and "Way Out Yonder
in the Golden West." The above numbers are
published by Leo Feist, Inc.,

This song is the hit of the "Show of Wonders,"
now playing at the Winter Garden, New York.
One feature of this song's success has been not
only its heavy sale in New York and elsewhere,
but the fact that the sale of records and music
rolls of the number have been very large. The
new Jass rolls have helped the sale also as the
song lends itself most readily to that sort of
arrangement.

New Numbers and Last Season's Successes All
Going Big
The songs released January 1 by Chas. K.
Harris are proving to be real lively additions to
the catalog of that frmrser Mr. Harris is giving
the numbers quite a little publicity, and this, to-
gether with the attractive title pages, is bring-
ing the songs before the music loving public.
Among this year's releases have been Van lind
Schenck and Jack Yellen's oriental serenade,
"My Little China Doll," and Van and Schenck
and Chas. K. Harris' novelty song, 'Xet Him
Miss You Just a Little Bit—and He'll Think
More of You," and a new ballad by Chas. K.
Harris, "You Came, You Saw, You Conquered."
These, together with last season's successes, "It's
a Long, Long Time. Since I've Been Home,"
"She Comes from a Quaint Little Town in Penn-
sylvania," "Songs of Yesterday" and "The Story
of a Soul" should give the sales staff of the Har-
ris house a busy season.

TWO NEW CARROLL NUMBERS
High Class Ballad and Novelty Song Now Being
Featured
"If I Could Call You Mine," a new semi-high-
class ballad, was recently released by the Will
Carroll Co., Inc., Brooklyn, N. Y. This song
is the work of Chas. E. Hochberg and Leo
Halperin, who have a number of successful songs
to their credit. This new ballad finds the Car-
roll staff very enthusiastic as to its future and
the" sales of the song since its publication justi-
fies them to a great extent. The above number
and the new novelty song, "She Came from
Philadelphia, But She Had the Ways of a New
York Girl," also published by the Carroll com-
pany, are to receive some good publicity.
