Considerable discussion has arisen over the
question whether any effective regulation of
industrial and commercial combinations can
be exercised under the authority of Congress.
Congress has, it is admitted, the power to
regulate commerce between the States, but
it is insisted that, while the authority of the
national legislature is inter-state in its na-
ture, the combinations themselves are State
creations, and any regulation that will be
constitutional can scarcely be effective in re-
sults. A way out of the difficulty is sought
by one of the national legislators in an
amendment to the Constitution, which gives
Congress the power to regulate commerce
"in the United States," puts corporations,
co-partnerships and joint-stock companies
under the control of Congress, and gives that
body power to regulate, control, prohibit and
dissolve all contracts and combinations in re-
straint of trade and commerce at the same
time leaving all powers conferred upon Con-
gress by the provision to be exercised by the
several States in the absence of legislation by
Congress. This amendment received the sup-
port of a majority of the House of Repre-
sentatives last year, and perhaps may suc-
ceed in making a better showing again. As The
Bradstreet's properly says, it is, however, an
exceedingly difficult matter to secure an
amendment of the country's organic law, and
perhaps it would be as well for those who
have the matter in hand to determine just
what are the limits of the power of Congress
under the commerce clause of the Consti-
tution as it stands.
