The appeal for a new trial is made on the
ground that the violin which was produced
in court at that time was not the Stradivarius
which Mrs. Bott lost, and that it could never
have been in the possession of Flechter, as
they have found what they claim is the genu-

the genuine Strad. He said that he had

made some repairs on it for Mrs. Springer
in 1897. lie said he had put a patch on the
inside along the bass bar, and when Assistant
District Attorney Sherman insisted he take
the instrument apart, it was found that the
patch was just as he had described.
Mrs. Springer said she bought the violin in
1896, and later sold it to one Dooley, who
disposed of it at a pawn shop, where she sub-
sequently recovered it, and that it had been
in her possession ever since.
