Some time ago a dentist, named Win. Zeno,
of this city, endeavored to palm off on the
gullible public a cheap stencilled piano, called
the " Everett." As soon as the matter was
brought to the attention of the John Church
Co., the factors of the only legitimate " Ever-
ett " piano made, they at once instituted pro-
ceedings through E. V. .Church, their local
manage^ for a temporary injunction, which
was at once granted. The matter has been
dragging along in the courts, and it was only
last week that a permanent injunction was se-
cured, as a matter of course, permanently en-
joining this man Zeno from using the name
" Everett." The order in the case, which was
issued by Judge Grosscup, is comprehensive
and definite, as can be seen from the excerpt
herewith:

cerned. I have no authority to speak for the
other creditors."
When asked if it wasn't true that Kerr's re-
port shows that nearly a thousand pianos can-
not be accounted for, Mr. McDougall said:
" It is true, I believe, that several hundred
pianos which it is claimed have been shipped
into the territory controlled by Smith & Nixon
are not shown to have been received by the in-
ventory. The assignors may be able, how-
ever, to clear this matter up. The method of
keeping books was faulty, and it may be pos-
sible that these instruments can yet be ac-
counted for."
As to what action will be taken by Mr. Me-
Dougall's clients he intimated that he had not
time to fully examine Mr. Kerr's report, and
could not give further information at the pres-
ent time.
A Winnipeg Failure.
The piano firm of R. H. Munn & Co., of
Winnipeg, Can., is financially embarrassed.
Two years ago they claimed a surplus of $32,-
000. Nine writs were issued against them with-
in a week, one for $5,70x5. Several Toronto
firms are creditors.
