Sec. 2. K.S.A. 21-4307 is hereby amended to read as follows:
21-4307. (1) Possession of a gambling device is knowingly pos
sessing or having custody or control, as owner, lessee, agent,
employee, bailee, or otherwise, of any gambling device.
Possession of a gambling device is a class B misdemeanor.
(2) It shall be a defense to a prosecution under this section that
the gambling device is an antique slot machine and that the
antique slot machine was not operated for gambling purposes
while in the owner's or the defendant's possession. A slot machine
shall be deemed an antique slot machine if it was manufactured
prior to the year 1950.

As used in this article,
unless the context otherwise requires:
(1) A person advances gambling activity if, acting other than as a
player, he engages in conduct that materially aids any form of gam
bling activity. Conduct of this nature includes but shall not be limited
to conducf directed toward (a) the creation or establishment of the
particular game, contest, scheme, device, or activity involved, (b) the
acquisition or maintenance of premises, paraphernalia, equipment, or
apparatus therefor, (c) the solicitation or inducement of persons to
participate therein, (d) the actual conduct of the playing phases
