Pistol Packin' Mama Sore
Capehart Has Birthday
NEW YORK- On September 23rd PM
reported th at the Edwin H. Morri s music
publishin g firm and th e Mayfair Music
Corporation , Morri s-own ed, were ready to
fil e suit against the America n Tobacco
Co., as sponsors of Lucky Strike Hit Pa-
rade asking damages of ~ 500 ,OOO.
Said PM: "Prime reason for the suit is
tha t Pistol Packin' Ma ma h asn' t been on
the Hit Parade. Not even in tenth place.
Th e music publishers claim th e omission
not only hurts th e presti ge of th e song but
also hurts its sale. Th ey feel th e son g
rates a place no lower tha n half way down
th e list.
"Th ey also accuse the Lucky S trike peo-
pl e of sli ghtin g S unda y, Monda y or Always.
This allegation is based on th eir claim
th at this son g has been numb er on e a nd
should . remain th ere. Fo r the non ce, at
least.
" According to the Lucky S trike Hit Pa-
rade peopl e, th eir list of 10 favo rite son gs
is compiled through a nationwide survey of
retail sheet music sales, record co mpa ni es,
juke boxes a nd requests received by th e
Nati on's lea ding orchestras.
" The suing music publishers base their
all egation . on a similar survey th ey made
during th e past two weeks which pla ced
Sunday, Monday or Always, first, Pistol
Packin' Mama, second and In' My Arms,
third. Th ey claim that Lucky Strike places
In M y Arms at th e bottom of th e list, Pistol
Packin' Mama nowh ere, and intends to
drop the . Sunday numbe, to fifth place.
"A private survey made last ni ght by
PM and condu cted in nearby Henderson's
Tavern , resulted as follows : Pistol 'Packin'
Mama was thri ce pl ayed on the juke box
during the consumption of three beers. No
other tunes were played."
INDIANAPOLIS- On June 6th the mail-

for Hom er E. Capehart, president of Pack-

he received more than 1,000 greetings from
f riends, and employees who hadn't forgot-
ten in was Homer's birthday.
Towards evenin g Ca pehart got ready to
hea d for hom e wh en an urgent message
came from one of the plant executives ask-
ing Cape to see him before leaving.
When he reached the fa ctory he was
greeted by more than 900 employees and
Packard orchestra sin gin g and playing
" H appy Birthday" and on the pl atform was
the bi ggest, three decker candle-spangled
b.irthday cake ever seen in these here parts.
From then on it was a typical Packard
party with the entertainment b eing fur ·
ni shed entirely by employees.
P ackard's annual employees pi cnic was
h eld at the American Athletic Club on Sep-
tember 19th. Employees enjoyed the ex-
clusive use of th e swimmin g pool, gymna-
sium, dancing from 3 to midni ght, an eight
act Aoor show and a su perb buffet picnic
lunch, all in the typical Capehart style.
