PERKINS GLUE DECISION
Circuit Court of Appeals for Sixth Circuit Re-
verses All Previous Decisions and Finds
for Perkins Glue Co.
The Perkins Glue Company, patentees of Perkins
Vegetable Glue, South Bend, Ind., under date of April
12, makes an announcement to all users and pros-
pective users of vegetable glue, believing they will
be interested in an important development in connec-
tion with the Perkins Glue Co.'s patent rights on
vegetable glue:
"After our patent for vegetable glue had been sus-
tained as valid and infringed by several of the
United States Courts in various suits which we
brought, the Circuit Court of Appeals for the Second
Circuit (sitting in New York), rendered a decision
holding the patent not infringed in that case," says
the announcement. "Shortly thereafter the Circuit
Court of Appeals for the 7th Circuit (sitting in Chi-
cago) handed down a similar decision holding that
the Kane glue (glue made with the Kane vegetable
material) did not infringe.
"The Circuit Court of Appeals for the Sixth Cir-
cuit (sitting in Cincinnati) has, however, now handed
down a decision holding that such Kane vegetable
glue (glue made from the Kane material) is an in-
fringement of our patent. We enclose complete copy
of the opinion handed down by the Sixth Circuit
Court of Appeals which we believe you will be in-
terested in reading.
"The decision, you will see, gives the patent a broad
construction, and the reasoning of the Court is such
that under the decision the infringing glue need not
necessarily be made from the Kane glue material,
but may equally well be made from other brands of
so called "raw" cassava and still fall within the pat-
ent and be an infringement.
"We are confident that this decision of the Sixth
Circuit Court of Appeals, holding that such glues
are infringements of our patent rights, will be fol-
lowed eventually in all suits hereafter to be tried."
The suit before the U. S. Court of Appeals (Sixth
Circuit) sitting in Cincinnati was heard before Cir-
cuit Judges Denison, Mack and Moorman, and deci-
sion was handed down March 18. In the decision
which reversed the findings of the second and seventh
circuits, the closing paragraphs read:
"With the greatest deference to the opinions of the
Circuit Court of Appeals of the Second and Seventh
Circuits, we find ourselves unable to concur with
them. Even if we could agree that their interpreta-
tion of the intent of the court in the original Solva
opinion was right we would still think that we ought
not to reach the same result as they do, because in
that event we would feel constrained not to follow
the Solva decision.
"The decree below is reversed, and the cause re-
manded for further proceedings in accordance with
this opinion."

P. B. Grojean, manager of the musical merchandise
department of the C. C. Baker Co., Columbus, O.,
has applied for a patent on a mute for trumpets.

Arthur Chapman Cheney, of the fine old piano
action industry which bears his name at Castleton,
N. Y., has been elected president of the National Ex-
change bank of that city to succeed the late Harvey
H. G. Ingalls. Prior to his election Mr. Cheney was
vice president. Mr. Cheney had been a director in the
bank and his activities in the business of the city had
long given prominence to his abilities and forceful-
ness.
Mr. Cheney besides is president of the Castleton
Public library, secretary and treasurer of the A. C-
Cheney Piano Action Company, owner of Chenwold
Farm, famous for its registered Guernsey cattle, and
vice president of the Castleton Building and Loan
Association.
