SAYS BASS NOTE WAS STOLEN
New York Music Publisher Asks $1,000,000 Damages,
Alleging Piracy of Single Note in Song.
Trial of the action instituted last spring by Fred
Fisher, music publisher, to restrain further singing of
the song, "Ka-lu-a" in the musical comedy, "Good
Morning, Dearie," was begun last week before Fed-
eral Judge Knox, in New York City. The defendants
are Charles Dillingham, the T. B. Harms Company,
Jerome Kern, Ann Caldwell and Edward Joyce.
It was alleged that a recurrent bass note in the
song "Dardanella" had been pirated and used in
"Ka-lu-a." The defendants contended the notes in
question were taken from works of musical masters
more or less ancient. While Mr. Fisher, the only
witness of the day, was testifying, musicians who will
later testify were practicing the disputed notes in an
adjoining room. Claims for damages amount to
about $1,000,000.

Harry Von Tilzer Commemorates 31st Anniversary
by Moving Into Larger Quarters.
Harry Von Tilzer, president of the Harry Von
Tilzer Music Publishing Company, Inc., New York,
this week will celebrate his thirty-first anniversary
as a song-writer, by moving his firm into larger quar-
ters at 1587 Broadway, where the third floor is
occupied.
Harry Von Tilzer is known as the dean of Ameri-
can song writers. He is the only living writer who
has consistently written songs for a period of thirty
years, and his successes include hits that still live
today. Thirty-two of these have just been incor-
porated in a collection published in book form that
is said to be selling like the proverbial hotcakes. Each
number has sold from one-half million to one and a
half million copies, and is still selling today.
The plug songs of the Von Tilzer firm are "Dear
Old Lady," "School Time," and Sophie Tucker's sen-
sational song hit, "The Little Wooden Whistle
Wouldn't Whistle." The "Dear Old Lady" song is
one hundred per cent mechanical, and is being fea-
tured by such acts as Heenry Burr, George McFar-
lane, Mabel McKinley, Mabel Burke, Tom Smith,
Lynn and Howland, Soprne Tucker, Irving Kauf-
man, Willie Smith and others.
The well-known Stanley picture houses are also fea-
turing the song with a one reel motion picture film,
used in connection with their orchestras. Dance or-
chestras using the number are Paul Specht's Hotel
Alamac Orchestra, the California Ramblers, Vincent
Lopez, Yerke's Jazzarimba Orchestra, Ray Miller,
Benson's Orchestra of Chicago, Isham Jones, Frank
Westphal, etc.
A brilliant future is predicted for the Harry Von
Tilzer firm, which now includes James Fero, business
manager; Sammy Smith, professional manager, and
an increasing general staff.

music publishers in the United States in attempting
to develop sales. These would lie chiefly among the
bands of British and Indian regiments stationed in
more than 100 Indian towns. Besides, in most of the
cities in India popular concerts are given weekly by
local orchestras or bands in the clubs or public parks
while numerous dances are given.
"Barney Google," a Remick hit, is the strongest
selling number in the sheet music department of the
McDougall-Conn Music Co., Portland, Ore. "Dreamy
Melody," another Remick song, is also proving a big
profit maker.

Herbert F. Dolan and Edward A. Morgan, Spring-
field, Mass., opened a music department on the first
floor in the annex of Poole's Bridge-street store last
week. A special attraction of the evening was a con-
cert by the Hotel Nonotuck orchestra of Holyoke
betweeen 3 and 5 p. m., and during the day musical
novelties were given out. This department will carry
a full line of sheet music, playerpiano rolls, records,
and all kinds of accessories. Both are members of
the American Federation of Musicians and have been
associated in musical circles professionally for a num-
ber of years.
