but there can be a misrepresentation which is not
fraudulent. There must be a dishonest found or in-
tention to deceive. To complete the elements which
are requisite to round an action of deceit it is also
necessary that the person to whom the false repre-
sentation was made was in fact deceived; that he was
"induced" to alter his position.
The authorities distinguish clearly enough between
knowledge of facts acquired by an agent in the course
of his particular employment and information which
he may have obtaned in the course of some other bus-
iness—nothing more than the former can be im-
puted to his principal. In other words, applying the
proposition to the piano business, if the agent was
paid by way of writing statements which the buyer
knows are untrue, there is no fraudulent misrepre-
sentation. But if the agent believes that the buyer
is ignorant of the truth in the case, he commits fraud
and the transaction may be nullified. The English
law, following the Roman, has steadily refused to
derine a fraudulent misrepresentation, for it is mind-
ful of the maxim, dolosus versatur in generalibus;
but when it rinds one in fact it will not be put off by
any artificial suggestions of imputed knowledge or
constructive notice.

FREE MUSIC SCHOOL
ESTABLISHED IN ROCKFORD
Vocal and Instrumental Lessons Provided in School
Under Schumann Piano Co.'s Auspices.
Lnder the auspices of Schumann Piano Company,
Rockford, 111., of which Fred Firestone is manager, a
free music school will be opened in that city in about
a month, and will continue until Sept. 1. This school
will be open to all students of voice and any instru-
ments selected free of charge and will be under the
direction of Mr. Firestone.
Registration may be made at any time at the store.
Any teachers who may wish to join the staff have
been asked to communicate with Mr, Firestone.
"There are so many children who fail to get the
proper musical education because of lack of funds,
that Mr. Firestone is offering this opportunity to all
children and older students who wish to study," says
the announcement in the Rockford newspapers. "Any
who wish to pay for their instruction may give what-
ever amounts they desire. Practice rooms and pianos
will be provided for those who do not have instru-
ments at home.
A new catalog just issued by the W. W. Kimball
Co., Chicago, is an instructive and interesting addi-
tion to piano literature. It is embellished with a
picture of the Kimball Building at Jackson and Wa-
bash, a frontisciepece which tells a pictorial story.
In the great seventeen-story structure are located
the headquarters, general office and salesrooms of the
W. W. Kimball Co., and Kimball Hall.
Four upright pianos, four grand pianos, a reproduc-
ing grandpiano, a reproducing upright, a player grand
and five player uprights are shown in handsome half-
tone cuts with accompanying text telling every de-
tail of the instruments.
The great building at Jackson and Wabash, the im-
mense piano and organ factories in the western part
of the city, and the big and varied line of instruments
produced therein are the results of definite principles
which have governed the house since the day of its
founding.
The W. VV. Kimball Co. solves the manufacturer's
problem by making its product coincide with the re-
quirements of the public. The house is an admirable
example of the artistic side of successful commer-
cialism. As the new catalog points out: "Kimball
Concert Grand Pianos express the highest ideals of
the concert and stage; Kimball Church Organs ac-
company the sacred church service all over this vast
continent; Kimball upright pianos are known from
coast to coast and Kimball playerpianos place music
itself at everybody's instant command."
PRAISED ASSOCIATIONS.
The late Sir Herbert Marshall, the head of Sir
Herbert Marshall & Sons, Ltd., London, was a con-
sistent pleader for trade associations, conventions and
the social side of the annual gatherings and always
pointed to the fact that man is a gregarious animal
and that the good side of every man is discoverable
if you get a chance to meet him under social circum-
stances. The English piano man always expressed
pleasure that the trade associations exist, whenever
the matter came up in conversation. He admitted
that the conventions had been the means by which
he had become acquainted with competitors who were
practically neighbors. Sir Herbert pointed to many
sterling friendships that existed between keen rivals
in the trade, simply because they took advantage of
the opportunities the conventions and their social
side afford.

Barnes & Strohber Co. has completely won the trade.
It is in demand wherever the instruments of the Chi-
cago and Milwaukee factories of the Smith, Barnes
& Strohber Co. are sold—and that comprehends a
good share of the active dealers throughout the coun-
try. There was a place for the "Chicago Electric"
and the attractive and unique case design and dec-
orative effects have helped to win a demand seldom
equaled in the same space of time.
It is not generally known that deceit on the part
of a salesman or in the publicity of a music house
may cancel a sale. Our laws are framed afjer the
old English law and this applies to the piano dealer
of today.
From early times it has been recognized that "every
deceit comprehends a lie, but a deceit is more than a
lie." It connotes more, and denotes less. There can-
not be a fraudulent representation which is not false,
The Dodge City Music Co., Dodge City, Kans.,
will open a branch this week in Garden City, Kans.,
under the management of C. Merval Rose assisted
by Charles Taylor. The new business will be known
as the Garden City Music Co. The Dodge City
Music Co. was founded by A. O . Drake and E. M.
Olsen in the fall of 1921. Mr. Olsen recently retired
from active interest in the company.

OBJECTED TO DELUGE

Complains That Dweller Upstairs Allowed Water to
Pour Down Upon Five Pianos.
Appearing in Yonkers City Court on Tuesday in
answer to a summons charging that she let water
pour downstairs into a music store owned by Mrs.
Mary Ackerman of 224 Riverdale avenue, Yonkers,
Mrs. Tillie Connery of that address alleged Mrs.
Ackerman provoked her by perpetual piano-playing
in her place of business.
Mrs. Connery told the judge that a playerpiano in
tlie Ackerman store often plays from 6 o'clock in the
morning until midnight and that the music becomes
monotonous and disturbs the sleep of members of
the Connery household. Mrs. Ackerman alleged that
Mrs. Connery let water pour down upon her in
revenge. Judge Charles W. Boote told Mrs. Connery
if the piano was played too much and at unreasonable
hours she could appeal to the Health Department,
but he urged both women to make peace, and save
both the deluge and the beautiful finish of the instru-
ments in the music store.

And James Crain Recalls a Humorous Incident of
'
Arkansas Travels.
James Crain, a Linn Creek, Mo., piano salesman,
who sold pianos and organs through remote coun-
ties in high Arkansas last summer, in telling about
it in a Chicago wholesale piano house this week,
said it was a right royal vacation even if the re-
sults in organ sales were smaller than expected and
those in piano sales hardly worth recording. . He
used a light wagon with strong springs set on low
wheels; a safe equipment, enabling him to climb the
steep grades on the flint strewn trails through the
forest-covered mountains. In this way he was able
to reach out-of-the-way places where the sight of a
stranger was as infrequent as is was welcome.
One day he pulled up at a farmhouse in a new
clearing and asked the farmer for a drink.
"Su'tinly, suh," said the Arkansan with the natural
hospitality of the state. "I'll give yo' all the best I
hew which is butte'milk.''
"Fine," said the salesman as he smacked his lips
after a deep sawllow. "My, wouldn't this be like the
nectar of the gods if it had a chunk of ice in it!"
"Ice?" exclaimed the backwoodsman.
"Yum-m-m!" signified the piano salesman, taking
another gulp. "A little bit of ice, highball size, would
make this buttermilk heavenly."
"Ice!" said the surprised farmer with a tug at his
whiskers. "Tee! Who in ta' nation ever heerd of
ice in July?"
