McCARTHY: I found o ut ne good area to loo k
in to is to see if it s like so m e bo dy else' ale ta x, if
someone is pro posing o ne. I fould "that anot he r
state was co py ing o ur ale t ax w o rd for w ord a nd
didn 't bo th er t o chec k into th fac t that it wa
knoc ked out in th e co urts. Now th a t terrific , if
the state tart s t o adopt a tax th a t 's bee n bea ten .
Actually , that s ho w we won the sa le t ax ca e. Th e
attorney general 's office won th e first ro und o n a
case th y fo ll o w ed . But th ey never follow ed it far
enough to find o ut that after th e co mpa ny went
bankrupt , they w o n in th e CQ urt of a ppea ls. It
didn t m ake any differe nce t o th e m any lo nger'
they w ere all wiped o ut . But the d ec isio n was
o verturn d.
PLAY METER: Was the New York a oc iatio n
very active in that ?

McCARTHY: Yes. I will say thi s. If you d o it
alone, fo r yo urself, it 's meaningles . I f yo u 're do ing
it as an a ociation fo r o ne thing, you advised
ever yo ne to withh o ld pa y m ent. Then th ey had a
lo t of peo pl e t o d eal with. Th e awfully big probl m
in th e indu try right now is a pa th y . They can be
told in a city th a t th ey are going to be faced with a
tax from th e city council a nd th ey' ll say, " h,
yeah if th y wa nt to d o it, t hey II d o it anyway.'
