Much Opposition to the Vestal Bill for Bar-
gaining By Copyright Owners and a Long
Drawn-Out Fight Is to Be Expected
Representative Chindblom, of Chicago, ex-
pressed himself before the House Committee
on Rules last week as being strongly opposed
to the enactment of the Vestal Bill (H. R.
13452) designed to secure to a musical copy-
right owner freedom of bargaining through the
revision of the Copyright Act of 1909 which
provides a flat royalty of two cents for each
mechanical reproduction of a copyrighted num-
ber. He calls attention to the fact that since
records usually have music on each side and
the wholesale price of a record averages thirty-
seven and a half cents, the copyright owner
under the present law receives over ten per
cent of the record price for his work, which,
the congressman contends, might be considered
a fair return.
The proposed amendment essentially affects
private interests, private capital, and large
stocks on hand, Mr. Chindblom said, and ex-
plained that the bill affects records in stock
because it is retroactive. He took exception,
too, to the fact that the bill as it now stands
does not take into consideration the new
means of reproducing music by means of
films.
Representative Michener of Adrian, Mich.,
defended the bill as being for the sole purpose
of giving creative genius the same rights of
protection as the patentee.

Simultaneously with the move to larger quar-
ters on the sixth floor at 645 Seventh avenue,
New York, the music publishing firm of Gene
Austin, Inc., has announced the appointment
of Edward E. Christy as a member of the firm.
Mr. Christy has been identified with the music
publishing business for many years and has
been in charge of the mechanical.department of
Irving Berlin, Inc., New York, for several years.
He has been made vice-president of the Austin
firm and will supervise the mechanical end for
the company.
Gene Austin, Inc., was the outgrowth of
Austin, Bloom & Koehler, Inc., and was origi-
nally formed about eighteen months ago in Chi-
cago. The firm moved to New York about a
year ago and changed its name with Gene Aus-
tin, well-known recording vocalist, as president
and Marty Bloom as general manager. The
building up of its catalog has worked for a
gradual expansion of the concern, which now
has about ten active songs, including ("Any-
one Can See With Half an Eye) I'm Crazy
Over You," "Wear a Hat With a Silver Lin-
ing," "Where's That Little Bluebird?" and
other catchy numbers. The quarters of the
firm now include a spacious suite of about four
rooms, as well as the former quarters which
are utilized as a stockroom.
