recently released by Jerome H. Remick Co.,
"Bring Back That Old-Fashioned Waltz," is
one of the best sellers on th eir count ers. It
was written by Albert Hay Malotte, a Buffa'lo
so ngwriter, who is becoming famous, for his
ability as a writer of waltz music. Over 3,000
copies have been sold in Buffalo. Other good

The newly organized American Guard, with
bra nches in many schools in the United States,
will have for its official march '''The American
Guard March," composed by Arthur Bergh, the
well-known musician and di rector of r ecording
for the Okeh records. "The American Guard
March" is a stirring rhythmical and musical
work, and had been dedicated by Bergh to th e
school children of America.
COMPELLED TO REPRINT AT ONCE
Boston Music Co. Issues Second Edition of
"The Night Before Christmas"
The Boston Music Co. ea rly thi s Fall placed
in the ha nds of th'e trade a musicali zed versio n
of Clement C. Moore's fam ous "The Night Be­
iore Christmas" (A Visit from St. Nicholas),
described as a spoken song by Hanna von
Vollenhoven. In preparation for the demands
of the holiday season the publisher issued an
original edition of 5,000 copies, but the mov e­
ment of thts number was so rapid that it was
neces sa ry to reprint it almost at once. The title
page is in several colors with a drawing by G.
G. Drayton, who made the Campbell soup kids
so famous.

A. J. Pi ron and his famous New Orleans Or­
chestra just arrived from New Orleans and
.will probably do some recording for some of
the lar ge mechanical companies. Piron has
some new jazz numbers and at lea s t one of
them will probably be as big a hit as his famous
"Sister Kate." The Clarence Williams Music
Co. is the publisher.

TAKES OUT SOCIETY LICENSE
Milwaukee Auditorium Recognizes Copyright
Property-White House Theatre Sued
MILWAUKEE,
WIS.,. N ove mber 26.- -The ::vlil­
waukee Auditorium, a quasi-municipal institu­
tion, has taken out a license from the America n
Society of Composers, Authors and Publishers
so that here afte r the boa rd of governors will
not be in constant danger of suits for infrin ge­
m ent of copyrights. During the rec ent Style
Show Fritzi Scheff was o·ne of the attractions
a nd sang "Kiss Me Again." ,\t the close of th e
s ho w the publishers' society threatened suit for
infringement, makin g the A uditorium board de­
fendant . This suit will now be dropped, it is
stated. The license was taken out at a cost of
$500 as a means of protecting people who r ent
the building.
The Skidmore Music Co., New York, owner
of the copyright on the song, "Last Ni ght on
th e Back Porch," has filed suit agai nst the White
House Theatre Co. to recover -dama ges for
alleged infringem en t. It is charged th e so·ng
was played by the White House Theatre organ­
ist for two days without permission and dam­
ages of $250, plus costs, are asked in the suit
which wa s filed in the Federal Court in Mil­
waukee on Novembe r 17. H. H. Heilbron, a
local attorney, represents the publishers' organi­
zation in all of th e liti ga tion which has arisen
recently.
MARKS NUMBER IN "(j0 WEST"
Th e E. B. Marks Music Co. has placed a song
in the s how "Go West, Young Man," which
rec entl y opened at the Punch and Judy Theat re,
N ew York. The number is entitled " Something
in the Sunset."
