Witmark & Sons Issue Booklet Featuring Ballads
by This Popular Composer
"Beautiful Ballads, Sacred and Secular," is the
caption adorning the title page of a useful and
interesting twenty-four-page catalog recently is-
sued by M. Witmark it Sons. The catalog is de
Included in the ballads are "Dear Little Boy of
Mine," "Down the Trail to Home, Sweet Home,"
"Till the Sands of the Desert Grow Cold," "I'll
Forget You," "In the Garden of My Heart," "Let
the Rest of the World Go By," "Love Me and
the World Is Mine,'" "Mother Machree," "My
Rosary for You" and "When Irish Eyes Are
Smiling." An alphabetical and classified list of
Mr. Ball's songs concludes the booklet, carrying
the titles of all his numbers in the Witmark Black
and White Series, popular songs and ballads, a
complete total of 147 songs, most of which were
at one time or another acknowledged best sellers
and a good portion of which are still active.

Hamilton S. Gordon Publishes New
Series by B. L. Jewett
Ernest Ball
voted exclusively to the songs written by Ernest
R. Ball during the past fifteen years, and is a
ready reference to his writing activities and
speaks well for his remarkable versatility.
The catalog itself is a sort of an appendix to
and companion of the famous Songland Catalog
issued by the same publishers last season in be-
half of the Witmark Black and White Series, and
which created much interest in the trade and
music-buying circles. Complete poem of each
song and a generous thematic fill the page, to-
gether with information as to the keys and vocal
arrangement in which each composition is avail-
able.
Novelty
Bernhard L. Jewett, author of the "Village
Idylls" suite, which includes "Carnival of Roses,"
"Dance of the Sylphs," "Album Leaf," "Song of
the Night" and "Valse Caprice," recently com-
pleted a new series carrying the titles "Scenes of
the Circus."
The numbers include "The
Pageant," "The Lion," "The Clown," "The Wire
Dancer," "The Race." All of the above works
by Mr. Jewett are published by Hamilton S. Gor-
don, who has given his newest series a striking
yet appropriate title page. The illustrations are
suggestive of the circus and the colors of the
title page carry out the idea.
NEW WITMARK NUMBERS
Several Numbers to Be Featured During Sum-
mer Months
"Serenade Blues" :s the title of a fox-trot nov-
elty by Noble and Sissle, writers, composers and
producers of "Shuffle Along." which was recently
added to the catalog of M. Witmark & Sons.
"Pinkie," a flapper song; "Say it While Dancing,"
"Heart's Desire" and "I Wish I Was in Dixie"
have also been released for a Summer campaign.
JUNE
Supreme Court Awards Damages to Fred Fisher,
Inc., in "Dardanella" Case
In the motion made in the Supreme Court by
Fred Fisher, Inc., that Felix Bernard, the writer
oi "Dardanella," be assessed damages for the
injunction obtained in 1920 restraining the music
publishing house from disbursing the moneys
received from the publishing and sale of the
song until the determination of the songwriter's
: uit for royalties, Justice Wasservogel last week
decided that Fred Fisher, Inc., was entitled to
d images. He appointed Edgar Bromberger, of
No. 56 Pine street, referee to ascertain the dam-
ages sustained to the publishing house by the
granting of the injunction.
Bernard's suit against Fred Fisher, Inc., aftei
hanging fire for nearly two years, was tried
recently in the Supreme Court. After the case
had been on for almost a full week Bernard dis-
continued his action. With reference to this
Justice Wasservogel said in his opinion: "The
discontinuance of the action on the trial over the
objection of the defendant was in effect a de-
termination. From the facts it appears that plain-
t ff was unable to prove his case, and in such event
the complaint would have been dismissed. De-
fendant was entitled to a determination and the
discontinuance granted by the court was in effect
such a determination." At the time the injunc-
t ; on was obtained against Fred Fisher, Inc., Ber-
nard put up a $1,000 bond guaranteeing any
damages that might follow.
THE BOLSHEVIK OPERA
An opera on Bolshevistic principles is sched-
uled to open in New York in October, under the
direction of Leon Bakst, with a cast of noted
Russian artists. It is said that every member
in the organization has a deciding voice as to the
manner in which a role is to be interpreted and in
the selection of costumes and other details of the
production.
