Popular Song Writer Passes Away in Local
Hospital After Long Illness
The United States Circuit Court of Appeals
on Friday last denied the appeal brought by
the Columbia Graphophone Co. against G. Ri-
cordi & Co., Inc., music publishers, growing out
of a decision in favor of the latter concern,
handed down by the District Court in June,
and ordered that the Columbia Co. must pay
a royalty of two cents for every record made
of the song "Dear Old Pal of Mine."
In view of the fact that the Columbia Co.,
after the decision of the District Court was
made June 23 last, sent notice to the music
publishers that they intended to make violin
records of the disputed song, as is required by
the Copyright Law, the court decided that the
injunction granted by the lower court should be
vacated, but that accounting of the records made
should continue.
The decision was based on the section of
the Copyright Law which provides that per-
sons or firms holding copyright to music may
not restrict the right to reproduce it in records
to any one concern. Granting of license to one
phonograph company is equivalent to licensing
all, providing that they pay 2 cents for every
record put on the market.
"It is required by law, however, that the phono-
graph company notify the holder of copyright
that records of any musical work are to be
made, and send a duplicate of the notice to the
copyright office in Washington.

The White Way Trio, featuring in Ned Way-
burn's Revue, now playing the Capitol Thea-
tre, New York, is programming the McKinley
Music Co.'s song "Floatin' Down to Cotton
Town." This number is one of the biggest suc-
