AN ACT to amend 945• 05 (2) of the statutes,
relating
to
proof
of
possession with intent to transfer a gambling device.
Analysis by the Legislative Rsference Bureau
Under present law,
proof of possession of a device designed
for gambling, even if the device is not in a gambling place or
set
up,
is prima facie evidence of the crime of possession with intent
to transfer a gambling device.
Prima facie evidence, if not rebut
ted by other evidence, would require a finding of guilty.
This proposal would make the presumption inapplicable if the
device is 30 years old or older.
The people of the state of
Wisconsin,

Thank you for calling our attention to Wisconsin Statutes Qiapter 945.05
(2) regarding gambling devices. This does seem to be an area that needs
clarification, and I have arranged for a bill to be drafted which would
create an exception under this provision for antique machines. It should
be ready in a few weeks if not sooner, and I will forward a copy to you
for your comments.
