Dakota Decision
Favors Free Plays
SIOUX FALLS, S. D.- Free pl ays were
ap proved in a decision ha nded down May
27 b y Judge Walter Conway who rul ed
pin ball offerin g free-play did not co nsti-
tute gamblin g devices.
The case involved th e City vs. Gilbert
Curry, operator of th e Spo rt Bowl whose
defen e had th e backing of th e S.D. Amuse-
ment Gam es Assn. and th e CM!. Ruling
affec t onl y this prin cipal South Dakota
city.
Th e Judge said he preferred to rely on
a circuit court opinion whi ch was contrary
to a statement by th e state a ttorn ey gen-
eral , Sigurd Anderso n, made in June 1946
to th e effect that free-play pin balls were
consid ered gamblin g devices.
JULY, 1948
The case was brought about last March
when a city detective impounded a Robin
Hood five-ball wh en he saw player place 12
nickels and get fou r free plays for a total
of 16 plays.
John O'Dowell, Curry's attorney, had
conferred with Dudley Ruttenberg, CMI
counsel, prior to th e trial with the result
a clear-cut victory for the Industry. Gener
Pruitt, assistant city attorn ey, prosecuted
the case for the city of Sioux Falls.
