County Common P leas Judge Fra nk H.
H arvey, in an important decision whi ch
call ed th e measure " un ce rta in and vague"
in many of its essential terms. Harvey is·
sued a perman ent injun ction res training
city officials a nd poli ce from a ttemptin g to
e nforce the measu re whi ch was enacted last
summer and pro vided fo r an a nnual li ce nse
fee of $20 a yea r for eac h box. Measure
simila rl y taxed a ll oth er co in·operated me·
chani cal devices.

subterfuge for a confisca tory tax." . This
point was not pa sed u pon. Howeve r, Jud ge

measure was "ambi guous" in th at it fa il ed

p layed th e box.
