Liquor Without Eats Nixed
LOS ANGELES.-The California Suo
preme COurt has ruled that only hotels,
restaurants and cafes so conducting their
businesses that the serving of meals consti-
tute the principal part of the business may
strve intoxicating liquors and then only
incidental, thereto ,
, Rilling came when the Court denied the
Southern California Tavern Association's
petition for hearing in the case of Ham-
mond vs. McDonald. The Court defines a
bona fide restaurant in the following man-
ner:
"A restaurant which is kept and operated I
for the purpose of furnishing meals to the
public for service of intoxi'cating liquors
therein being merely incidental to that
tusiness, is what it purports to be, and is
therefore a bona fide restaurant, and may
as a casual an'd incidental part of its
business sell such liquors and allow their
consumvtion upon the premises, even with-
out meals. But where the principal busi-
ness of the restaurant becomes the sale
and service of intoxicating liquors, which
are consumed on the premises, with th ~
sale and service of meals the incidental
matter, or 'side line,' such place is no
longer a bona fide restaurant, but is to be
regarded as a public saloon or barroom
within the intent of the Constituti'o nal pro-
visions, and the sale 9f such liquors therein
lire prohibited."
