or suspended for any cause for which th e
permit might h ave b een refu sed in the first
place.
That the City considers P ay·Outs and
Free·Plays two entirely differ ent types of
equipment is made very clear by the Ordi·
n ance which states :
" No license shall b e issued for any coin
operated amusement device which is so
constructed as to make possibl e eith er di·
rectly or by the use of an a djustment, the
return of cash , tickets, discs or other tokens
or certi fica tes of any ki nd to a player op·
erating the same, whether or not such
tokens or certificates h ave a value of any
kind. Only machines operated exclusively
for the amusement provided by the oper·
ation thereof shall be licensed and no rna·
chin e 'shall return and no exhibitor shall
offer or give any reward or thin g of value
as a reward for the making of any score or
accomplishing any result in the playing of
such machine, except that as a reward
for his skill, the player may be given
free games."
Th e second line which the ordinance
draws between phonographs and other
"amusement" machines is in placement
near schools. Only music can be operated
within 300 feet of any elementary school
and th e ordinance prohibits persons under
16 years of age from playing th e tables
regardless of where they are loca ted.
Although the new law requires th e name
of the own er to b e posted at all times on
each uni t includin g his address as well as

Anoth er presti'ge factor in the new meas·
ure is that whi ch requires that all coin
operated amusement premises shall b e open
to th e inspection of th e Welfare and Police
Departments a t all times.
Quite frankly the or dinance takes the
view long expressed by local coin machine
operators in the manner of wh ether or not
a F ree·play game is a gambling machine.
It h as always been a wi dely accepted con·
tention that any game may be turned by
anyone to gambling purposes but that
amusement tables offer no more incentive
to gamble than football or croquet.
In explaining the complete legalizing of
th e machine the measure states: "Sections
9·1.1 to 9·1.16 hereof are declared to h ave
b een enacted pursuant to the power of the
City to impose licenses upon occu pations
and whereas amusemen t vendi'ng machines
may potentially be used as gamblin g de·
vices, said sections are enac ted also pur·
suant to the police power of the City."
That the city intends to co·operate with
local operators in developin g and ma intain·
ing the type of Free·Play management
which it desires is brou ght out b y a new
section of the ordinan ce whi ch allows the
opera tor five days to comply with wh at
ei ther the Commissioner of Li censes or Di·
rector of Welfare may consi der a violation
of this code.
