partment to put an end to the penny
candy “ racket” . This racket consists
in the practice o f selling penny candy
or gum to children through the lure
o f prizes to lucky purchasers. The
prizes range all the way from pennies
to pennants.
The candy gambling has been espe
cially prevalent in the vicinity o f pub
lic schools. Candy and confectionery
stores especially have been a fruitful
source fo r this type o f gambling. The
Mayor, upon being informed o f the
prevalence o f this type o f gambling,
wrote to Police Commissioner Valen
tine, instructing him to put an end to
it. The police, follow ing the M ayor’s
direction, will issue warnings fo r a
week. A fter that period o f time, shop
keepers found selling candy and gum
o f the gambling variety, will be ar
rested.

letter, Commissioner Valentine sent

an order to all precinct commanders
to inform all manufacturers, jobbers
and distributors that the manufacture,
sale and distribution o f candy for sale
by “ gambling methods” shall cease.
All retail candy sellers were ordered
notified to discontinue the sale.
The Mayor vehemently attacked
this type o f racket in his letter,
charging that this method o f selling
candy especially “ exploits children
who are unable to protect themselves.”
“ The amount o f return received
from the expenditure o f money is made
to depend upon chance,” he said. “ It
is clear that the practice is o f a
reprehensible sort which the common
law and criminal statutes have long
deemed to be contrary to public pol
icy.”
The Mayor explained that one me
thod o f candy gambling consisted in
the display o f a number o f pieces o f
candy, a few o f which have a penny
concealed inside their wrapper. A n
other gives prizes fo r pieces o f candy
with colored centers; white centers
bringing no return.
Lucky purchasers o f colored ball
gum are also rewarded through the
receipt o f prizes, usually pennants.
There is a type o f candy which has
its purchase price, ranging from one
to three cents; inside the wrapper.
The Mayor charged that candy sold
in this way is either smaller than that
sold legitimately, or is o f an inferior
quality.
“ I have conferred with educational
and social welfare authorities on this
subject,” said the Mayor, “ and they
are in agreement that this practice
encourages and engenders gambling
in children.”
