industry is the following letter written to WLW by
Max Hurvich of the Birmingham Vending Co.

Gentlemen:
As is our usual custom, the writer
and family were listening to W L W
broadcast last night. When the
K.O O LO X program was announced,
we listened to it as we would to any
other program.

However, when the “true” story of
pin ball machines was given, we were
frankly astounded. That the writer
of the “ M E L O D R A M A ” has reflected
on an entire industry that is giving
employment to thousands of people
in the United States, we will not
discuss in detail. We will leave that
to the manufacturers.

However, when this eager writer
for the sensational reflects on thou­
sands of operators and merchants all
over the country, we feel some objec­
tion should be raised. To begin with,
the writer and his customer-operators
are all law-abiding citizens. Most of
them have lived in their communities
most of their lives, and we resent
the reflection cast on us by this
writer. We wish to advise him to
begin w ith that we have no connec­
tion with any “ C O U N S E L O R ” or
click in some other city. We, as well
as all of the other operators in this
territory operate our business as
any other business is conducted.
W e believe this writer, and the
manufacturers of K O O L O X would re­
sent very much if we were to broad­
cast the report that your product is
made of inferior materials and that
you are perpetrating a hoax on the
American people. We further feel
you would resent it if we stated your
announced contest was a frame-up
and that you will give the prizes to
certain picked people, regardless of
the merits of letters sent in. How­
ever, this would be no more exag­
geration than some of the statements
your “ character actors” portrayed on
this station broadcast.
First of all, let me inform this
writer on some pertinent facts that
he might have learned himself, if he

had been honest enough to investi­
gate. Pin ball machines are wanted
by the merchants. I f he had investi­
gated among merchants, he would
have learned that these machines
have been instrumental in keeping
the doors open for some small mer­
chants. Not only have they not been
intimidated into taking these ma­
chines, but they have repeatedly
called operators for machines. It is
true we can speak only of this terri­
tory, but we are confident this is
true all over the United States.
Y our actor sarcastically referred
to the sinister methods of salesman­
ship adopted by these non-existent
racketeers. Surely he cannot over­
look the fact that you are compelling
gullible people to purchase your prod­
uct in an effort to win one of the
few prizes you offer as bait. After
all, no one is compelled to play pin
hall machines placed in merchants’
locations. And, according to the an­
nouncement last night, a carton of
your product must accompany the
slogan sent in.
We realize the effect you desired
has already been accomplished, but
We must call your attention to an­
other fact. While it has been some
years, the writer still recalls the days
^e played marbles in school for
“keeps.” Yes, and we even pitched
to the line for pennies or marbles.
And, there were no pin ball machines
at that time. Perhaps the writer of
this skit didn’t do that when he was
f hoy, but we believe if he would
investigate, he would find this condi­
tion existing today.
We wish to inform him that no
operator in the United States wants
the children to play machines. We
have co-operated with local authori­
ses, and believe every operator would
do likewise, in making it unlawful for
children to play machines. We do
n°t want children to spend their
lunch money and “FAINT FOR
•HUNGER” as you so dramatically
Portrayed. However, you cannot era­
dicate this entirely any more than you
can prevent boys and girls from doing
the other things they shouldn’t do.
No right-minded citizen approves
any rackets, and we believe they
hould be stamped out. However, to

garble machine industry is controlled
tu racketeers is as unfair as to say
e shaving cream industry, or any
other established business is similarly
